webMOBI Privacy Policy
1. Purpose and Scope
This Privacy Policy (“Policy”) explains how personal information is collected, used, and disclosed with respect to your use of our website located at www.webmobi.com (the “Site”) and the software and services accessed through the Site and your mobile device (the “Service”), provided by Mendios Technologies (webMOBI), or its subsidiaries or affiliated companies (“WebMobi”, “we” or “us”), so you can make an informed decision about using the Service. This Policy applies to all of the products, services and websites offered by WebMobi. Product specific privacy notices may be posted to explain our products in more detail.
By using the Service, you represent that you are 13 years old or older and consent to the privacy practices described in this Policy, as may be modified by us from time to time. We reserve the right to change the provisions of this Policy at any time. We will alert you that changes have been made by indicating on the top of the privacy policy the date it was last updated. Your use of the Site following the posting of such changes or revised statement shall constitute your consent to any changes in our privacy practices, and you expressly waive any right to notice of such changes. We encourage you to review this Policy whenever you visit our Site to make sure that you understand how any personal information you provide will be used.
2. Transparency Notice - Information we collect and how we use it
webMOBI collects Personal Information regarding its current, prospective, and former clients, customers, users, visitors, guests, and employees (collectively “Individuals”).
We may collect the following types of information:
webMOBI Customers - If you are a webMOBI Customer, you may provide Personal Information when you register with us through the Site to create and manage apps, such as your name, company name, email address, and “Payment Information” such as billing address and credit card information.
End Users - When you download or use the webMOBI App, any app published there or elsewhere, and/or use app through the Site, you may choose to provide Personal Information for your registration and/or profile as follows: Name, email, photo/profile image, Company, Position/Title, Gender, phone number, and/or website (“Profile Information”). Linked social media accounts such as Facebook, Twitter, Google+ and LinkedIn (“Social Information”). If, when you create an account with us, you may choose to login using certain social media accounts (Facebook, LinkedIn, etc). In this case, we collect the login identifier and password from this account (“Social Logins”). We collect your Mobile ID when you download the webMOBI App or a branded webMOBI app. If your device enables location services for the webMOBI App, we will collect information about your location when you use the App. You may send messages to other End Users or connect with them, in which case we will collect records and data reflecting your interactions with the other users. You may be asked, but not required, to complete surveys about your use of the webMOBI App. Note that this information is treated like Profile Information for purposes of this policy.
Visitors - This Section describes the information that we may collect from Visitors. To the extent you are a webMOBI Customer or an End User and visit the Site or use the webMOBI App, this Section will apply to you as well: If you contact us by email or by filling-out a registration form, we may keep a record of information you provide, such as contact information and correspondence. We will collect Usage Information reflecting your behavior on the Site. We may use session and persistent cookies, both first-party and third-party, to collect information about your visits to the Site.
Additional Information and Data Collection
Mobile-specific information we collect Most of the personally identifying information we collect is what you tell us about yourself.
Most of the other information we collect for mobile, such as your device and hardware IDs and device type, the request type, your carrier, your carrier user ID, the content of your request, and basic usage stats about your device and use of WebMobi mobile application services does not by itself identify you to WebMobi, though it may be unique or consist of or contain information that you consider personal

In addition to the above, we may use the information we collect to:
Provide, maintain, protect, and improve our Services (including advertising services) and develop new services based on user activity and preferences; and Protect the rights or property of WebMobi or our users. Store, process and maintain your content in order to provide the Service to you. Content you create with WebMobi may, if you choose, be read, copied, used and redistributed by people you know or, again if you choose, by people you do not know. We suggest avoiding sharing sensitive information. However, if you choose to do so, use care when sharing.
If we use this information in a manner different than the purpose for which it was collected, then we will ask for your consent prior to such use.
WebMobi processes personal information on Amazon Web Services. WebMobi uses Amazon Web Services to host its infrastructure. Amazon Web Services servers are located in the United States of America, Europe and Asia. In some cases, we process personal information outside your own country.
Choices
You may terminate your use of WebMobi at any time.
Most browsers are initially set up to accept cookies, but you can reset your browser to refuse all cookies or to indicate when a cookie is being sent. However, some WebMobi features and Services may not function properly if your cookies are disabled.
4. Information sharing - webMOBI may disclose information
WebMobi only shares personal information with other companies or individuals outside of WebMobi in the following limited circumstances:
We have your consent. We require opt-in consent for the sharing of any sensitive personal information. We provide such information to our subsidiaries, affiliated companies or other trusted businesses or persons for the purpose of processing personal information on our behalf. We require that these parties agree to process such information based on our instructions and in compliance with this Privacy Policy and any other appropriate confidentiality and security measures. We have a good faith belief that access, use, preservation or disclosure of such information is reasonably necessary to (a) satisfy any applicable law, regulation, legal process or enforceable governmental request, (b) enforce applicable Terms of Service, including investigation of potential violations thereof, (c) detect, prevent, or otherwise address fraud, security or technical issues, or (d) protect against harm to the rights, property or safety of WebMobi, its users or the public as required or permitted by law.
If WebMobi becomes involved in a merger, acquisition, or any form of sale of some or all of its assets, we will ensure the confidentiality of any personal information involved in such transactions and provide notice before personal information is transferred and becomes subject to a different privacy policy.
5. Information security
We take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. These include internal reviews of our data collection, storage and processing practices and security measures, including appropriate encryption and strategic structuring of our infrastructure.
We restrict access to personal information to WebMobi employees, contractors and agents who need to know that information in order to process it on our behalf. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations.
Accessing and updating personal information
When you use WebMobi Services, we make good faith efforts to provide you with access to your personal information and either to correct this data if it is inaccurate or to delete such data at your request if it is not otherwise required to be retained by law or for legitimate business purposes. We ask individual users to identify themselves and the information requested to be accessed, corrected or removed before processing such requests, and we may decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort, jeopardize the privacy of others, or would be extremely impractical (for instance, requests concerning information residing on backup tapes), or for which access is not otherwise required. In any case where we provide information access and correction, we perform this service free of charge, except if doing so would require a disproportionate effort. Because of the way we maintain certain services, after you delete your information, residual copies may take a period of time before they are deleted from our active servers and may remain in our backup systems.
Privacy Shield – International data transfers
If you choose to use the Services from the European Union (“EU”), Switzerland or other regions of the world with laws governing data collection and use that may differ from the law of the United States of America (“US”), please note that you are transferring your personal information outside of those regions to the US for storage and processing. By providing any information, including personal information about you, on or to the Services, you consent to such transfer, storage, and processing. We participate in, and comply with, the Privacy Shield Principles regarding the collection, use, sharing, and retention of personal information from the EU and Switzerland. If there is any conflict between the terms in this Policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. Our participation in Privacy Shield applies to all personal data that is subject to this Policy and is received from the EU or Switzerland. In certain circumstances, you may have the right to invoke binding arbitration under Privacy Shield, as described in Annex I to the Privacy Shield Principles, which can be found at the following URL: https://www.privacyshield.gov/article?id=ANNEX-I-introduction. As a Privacy Shield participant, we are subject to the investigatory and enforcement powers of the US Federal Trade Commission and other authorized statutory bodies. Under certain circumstances, we may be liable for the transfer of personal data that we receive and subsequently transfer to a third party, as described in the Privacy Shield Principles. As described in this Policy, we may share information with third parties and may be required to disclose information in response to lawful requests by public authorities, including to meet national security or law enforcement requirements. You may also contact us to request that we do not disclose your personal information to third parties (other than those that are acting as our agent to perform tasks on our behalf, such as payment and data processors). However, as the core functionality of the Services require that we share your information with Clients, you will not be able to use the Services if you request that we not disclose your information to third parties.
Enforcement
WebMobi regularly reviews its compliance with this Privacy Policy. We will cooperate with the appropriate regulatory authorities, including local data protection authorities, to resolve any complaints regarding the transfer of personal data that cannot be resolved between WebMobi and an individual.
